One year after the reform of Brazilian Consolidação das Leis do Trabalho (“CLT”), by means of which the possibility of submitting individual labor disputes to arbitration was expressly included in Brazilian Labor Law, uncertainties remain, mainly in the case law field. It is important to analyze this issue, especially in view of the possibility of a new reform of CLT and due to rumors of the extinction of Labor State Courts. This paper aims to critically analyze the scenario prior to the reform of CLT, the statutory amendments made by the reform regarding this issue, as well as doctrine and case law in such periods. |
