The article discusses the challenges faced by the U.S. federal government by the conflict aroused due to the intersecting principles of the forced speech doctrine and the commercial speech doctrine under the application of the First Amendment jurisprudence of the U.S. Constitution. It analyzes the judicial decision of several cases including Zauderer v. Office of Disciplinary Counsel, Ohralik v. Ohio State Bar Association, and West Virginia State Board of Education v. Barnette. |
