In this article, the author discusses the judgment of the case of the Technology and Construction Court in Walter Lilly & Company Ltd v. Mackay (No 2) regarding issue of legal advice privilege. It informs that the court referred to the report of the case R (On the application of Prudential pic) v. Special Commissioner of Income Tax regarding communications between an employer and employee under a building contract. It mentions that legal advice privilege will be confined at common law. |
