The article examines the decision of the U.S. Court of Appeals for the Seventh Circuit in the Court case Wigod v. Wells Fargo Bank, N.A. In this case, the court held that a borrower may sue a lender for state law breach of contract and related claim who fails to comply with a modification agreement under the Home Affordable Modification Program (HAMP). It discusses provisions of state law claims related to the breach of a trial period plan payment (TPP) agreement. |
