The office of governor has become the focus of controversy since the governor has to function on several occasions bypassing the advice of the Council of Ministers under Article 356 and 357, of the Constitution of India. By and large, the controversies crop up in those states where the governor report under Article 356 that the government of the state cannot be carried out according to the provisions of the Constitution and the President takes over the government in the state on receipt of such report and the government concerned continues to function under the authority of the President and without the aid and advice of a responsible Council of Ministers. It would not be incorrect to say that is an unusual power which has been used by the Congress ruled Central government very often in an unusual manner with one or the other excuse specially after 1967, Article 356 of the constitution, which provides for the imposition of President's Rule when there is a "failure of constitutional machinery in the state " has been most controversial.
