| Abstrakt: | The article discusses the nature of the tuna fishing ban as a negative servitude created on a pactionibus et stipulationibus basis. Starting from the opinion of Ulpiano, a discussion is presented regarding the different theories about the nature of this prohibition and whether it is a servitude or not. Different authors explain their theses on the reasons why such ban is imposed upon the purchase of a farm property to the buyer, which results in many other legal situations beyond a simple purchase contract. |
