The article examines the impact of the Directorate General for Competition of the European Commission's (DG COMP) sector inquiry on the European pharmaceutical industry after its launch in 2008. It mentions that the establishment of the sector inquiry has created legal uncertainty on the legitimacy to investigate firms for practices in compatibility with European Union (EU) competition law. It notes that the effect of the sector inquiry on the introduction of the EU patent remains unclear. |
