The author discusses a judgment by the European Union (EU) Court of Justice that may provide an opening for civil antitrust plaintiffs in the U.S. to get records from the European Commission's (EC) investigations. In Pfleiderer AC v. Bunderskartellamt The Court of Justice's interpretation of EU competition laws is indicated as an important step for antitrust plaintiffs to get discovery. It notes that the case has created opportunities for plaintiffs to tip the balance in favor of production. |
