The article offers an approach on how to handle a staff member in misconduct cases such as theft in Australia. It provides and overview of summary dismissal which is termination of an employee on the spot based on serious misconduct which could expose an employer to unfair dismissal claim if not handled correctly. It identifies standards based on the size of the business in relation to proving misconduct which include the Small Business Unfair Dismissal Code and the Fair Work Act. |
