R. v Walker.

Abstrakt: The article discusses the British court case R. vs. Walker wherein the sentencing judge held that the defendant's interest as a beneficiary under a trust established by his grandfather was not free party and could not be confiscated as part of the recoverable amount in his case. Confiscation proceedings were initiated after he was sentenced to imprisonment for possessing a controlled drug and other offenses. The definition of "available amount" in section 7 of the Proceeds of Crime Act 2002 is also discussed.
