The article presents the uncertain significance of title in distributing marital assets in Georgia. It notes the move of the court to use property division in divorce not only for partitioning of jointly owned property but to determine who owns the property when title is disputed. It mentions the move of the Supreme Court of Georgia to adopt an active/passive appreciation test in which a non-titled spouse could claim that separate asset appreciated due to marital efforts. |
