Abstrakt: | The article discusses how the Third Circuit handles class-arbitration waivers by providing information on the Homa v. Americal Express Co. court case as well as the role of class-arbitration waivers in mandatory arbitration clauses. The author presents the trend among circuit courts to refuse upholding class-arbitration waivers. According to him, an effective blueprint was provided by the decision of the Third Circuit in the Homa v. Americal Express Co. court case which can be used in setting the standards in the evaluation of class-arbitration waivers. |
