The article focuses on the legality of industrial applicability to disclose patent validity. It relates the court case Eli Lilly and Co v. Human Genome Sciences Inc. concerning the use of industrial applicability to identify patent validity directed to genetic sequences. It adds that the Great Britain court ruled the invalidity of patent in the said court case, while the European Patent Office (EPO) reversed. Moreover, judge Jacob L. J. held the need for industrial applicability's preciseness. |
