Abstrakt: The article presents a judicial review of antidumping and countervailing duty determinations issued by the U.S. Department of Commerce concerning 28 U.S.C. § 1581 (C). Included is a discussion on zeroing, an issue that has been addressed in prior years by both the Court of International Trade (CIT) and the U.S. Court of Appeals. An important issue is the Department of Commerce's application of adverse facts available (AFA) when responding parties failed to cooperate to the best of their ability in the corresponding administrative proceeding.
