Abstrakt: The article investigates whether the creation of a National Security Court System (NCSC) could allow for the most efficient and effective prosecution of high-valued detainees at the Guantanamo Bay Detention Center in Cuba. It looks into the relationship between the NCSC and the International Criminal Court (ICC) and their approaches to the law of enforcement under a federal judicial system and the law of war under a military judicial system. The basis of the NSCS would be a statute court that adjudicates war crimes.
