The article discusses a court case in Great Britain wherein two defendants, the first convicted of murder while the other convicted as a secondary party, appealed on the ground, inter alia, that the judge had wrongly directed the jury in relation to joint enterprise. The court allowed the appeal, explaining joint enterprise cases where the common purpose was not to kill but to cause serious harm. The article discusses the laws governing causation and secondary liability and joint enterprise liability. |
