The article looks at the appropriate practice of adjudication based on the court case between the Fair Trading Commission (FTC) and the Jamaica Stock Exchange (JSE). It examines the adjudication made by the FTC in the fair competition complaint filed against JSE and states the need for structural change in the FTC. The author also suggests the creation of an independent and specialist tribunal in which would be completely separate from the Commission and would hear only competition complaints. |
