Abstrakt:	The article discusses the approaches to determine whether a person has the capacity to consent to sexual activity in nursing homes. It discusses the case-by-case method used by more liberal institutions and the Mini-Mental State Examination used by more conservative institutions. Nursing homes resort to other options, including limited capacity systems, guardianship, and training and education for institutions' staffs, residents and their families.
