The article discusses a court case regarding the extent of effect of the release of a lessee's obligations on the assignee and assignee's guarantor. It relates the case involving Byrne J, a lessee who rejected to the argument of allowing the lessor recover after a deed of release has been signed in 2006, since he was following the traditional law of leases. The implications of the decision on fundamental principles of a lessee on the performance of covenants in the lease is also highlighted. |
