This article explores the rights of a trustee in bankruptcy and the rights of the separated spouse of the bankrupt person in family law cases in Australia. It relates the cases to the Bankruptcy and Family Law Legislation Amendment Act 2005. It also examines the effect of the amendment on the Full Court of the Family Court's decision of Lemnos & Lemnos. |
