Abstrakt: |
The article discusses the tests for terms implied in fact by the Privy Council. It notes that Lord Hoffmann is the one who sets out the objects of the courts in implying the terms in fact, and clarifies the role and relationship of business efficacy and officious bystander. To evaluate, several court cases are explored such as the Attorney General of Belize v Belize Telecom Ltd., and Bratton Seymour Service Co Ltd v Oxborough. Further discussion on the interpretation of the terms are included. |
