Abstrakt: The article explores the involvement of the U.S. Congress in the Federal Rules of Evidence which prioritizes reason over emotion in the courtroom. The article examines how the Congress amended and adopted the Federal Rules of Evidence under the Rules Enabling Act. It discusses concerns of legal professions over the ability of jurors to weigh evidence specifically in the Rules 401 and 404. It calls on the Congress to refrain from amending the rules and limit its involvement to adopting or rejecting changes proposed by the Judicial Conference.
