The article examines Policy 17 created by the Humber Students' Federation (HSF) which effectively precluded a member or director of another student association or advocacy group at Humber College in Toronto, Ontario from being a director of the HSF unless the group had been sanctioned by HSF. The applicant Rakowski was a member of the National Association of Disabled Students, a group not sanctioned by HSF, and he challenged his ineligibility to be a director or the president of HSF because of the operation of Policy 17. He applied to have the Policy declared invalid on several grounds, namely, that it was unreasonable, discriminatory, and inconsistent with the objects of HSF. The court's ruling on the case is detailed. |
