The article discusses the case of Bennett v Commonwealth concerning the validity of the Norfolk Island Amendment Act 2004. A section of the act conferred on the Commonwealth Parliament to authority to make laws for the government of any territory. The amendments made the possession of Australian citizenshipa condition for voting and membership of the Legislative Assembly of Norfolk Island. The facts of the case are presented, as well as the cases cited during the trial. |
