Abstrakt: The article reports on the significance of seeking patent opinions from lawyers on issues concerning patent infringement involving business enterprises in the U.S. It explores the various cases on patent infringement and explains on how patent opinions can help companies address such allegations. It was found that willful infringement are the common lawsuits filed by defendants which causes them to pay the damages brought to the patentee. A discussion on the case of Knorr-Bremse Systeme Fuer Nutzfahrzeuge GmbH versus Dana Corp. was also explored which focuses on the approach shown by courts in handling cases when defendants fail to obtain opinions.
