The article focuses on the U.S. Court of Appeals for the Third Circuit's interpretation of religion-based peremptory challenges. It offers a brief overview of the law governing peremptory challenges and the Equal Protection Clause. It details the Third Circuit's decision in United States versus DeJesus, particularly how the court distinguished religious affiliation from religious belief. It argues that all religion-based peremptory challenges should be held unconstitutional. |
