Abstrakt: The article discusses provisions in the law that protects tenants in cases of default by mortgagors under the Residential Tenancies Act (RTA) in New South Wales. The RTA is a remedial consumer-protection law which provides for the procurement of a court order before a tenant can be evicted from the mortgage premises. Moreover, the article discusses the absence of tenancy notice by mortgagee and the circumstance where tenancy was created in breach of the mortgage contract. INSET: Relevant provisions.
