Abstrakt: The article discusses the privileges of a writer to conceal the identity of their confidential sources or other information gathered in the course of their work. The issue sprung when reporter Judith Miller was sent to jail in Alexandria, Virginia, for a period of eighty-five days for contempt of court after defying a judge's order directing her to testify before a federal grand jury in what has become known as the Central Intelligence Agency Leak case. Miller asserts her reporter's privilege, contesting that confidentiality is considerably essential to the freedom of the press. However, it was contended by the Chief Judge that grand jury materials submitted under seal by the Special Counsel were sufficient to overcome any privilege under the most stringent of balancing tests.
