The article points out that lawyers in Australia have to examine carefully the implications of the High Court's decision on the Cummins case particularly to those who seek asset protection by placing matrimonial property to the spouse who is not at risk. The families of bankrupts and their lawyers have to consider whether to invoke the jurisdiction of the Family Court to protect their position. |
