Abstrakt: The article examines whether Massachusetts can legally justify disparate treatment of non-resident, same-sex couples who wish to obtain licenses to marry in the state. The state marriage evasion statutes were analyzed as it applied to same-sex couples with respect to Article IV, Section 2, Clause 1 of the U.S. Constitution. The author urges the Supreme Judicial Court of Massachusetts to hold the Massachusetts evasion statute in violation of the U.S. Constitution.
