This paper examines the approaches to harmonise the conflict between patent protection on medicines with the demand to access the medicines. The method used is documentary analysis under the doctrinal research methods. Patents on medicines create monopoly rights for the inventors that give the patent-holder monopoly over the invention for a certain period. These monopolies create the issue of access to medicines. The issue has been studied using empirical data measuring the access to medicines vis-à-vis affordability. This paper examines the conflict of rights from a jurisprudential perspective. The analysis also tries to suggest the possible harmonisation potentials for access to medicines and patents on medicines. [ABSTRACT FROM AUTHOR] |
