Abstrakt: |
There are increasing reports of physical attacks targeting individuals who use cryptoassets, including cryptocurrencies like Bitcoin and Ethereum. Can property-based offences be relied l, pon to prosecute such activities? This article seeks to answer that question by examining the applicability of the offences of theft and burglary under the Theft Act 1968. We argue that the 1968 Act is capable of embracing wrongdoing in relation to this new asset class and, in particular, that cryptoassets are capable of being stolen. However, a number of interpretative challenges and uncertainties remain. We highlight these areas and suggest routes for the criminal courts to take when called upon to resolve them.
