The article offers information on the Canadian Supreme Court cases such as R. v. Anderson in which the defendant was charged for driving with excess blood alcohol and was reviewed by the prosecutorial discretion. Topics discussed include the decision of the crown attorney challenged by Anderson on the basis of his aboriginal heritage, the need of a sentence imposed on a person to be as stated in s. 718.1 of the Criminal Code, and the issue of proportionality in sentencing reviewed by the court. |
