Abstrakt: The authors argue that the European Patent Office's Enlarged Board of Appeal (EBoA) should be mindful that its mandate is to grant or refuse patents in conjunction with the interests of society at large, rather than the preferences of various patent applicants. Several patent eligibility legal cases at the EBoA involving transgenic plants, plant bioscience, and the State of Israel are mentioned. The European Patent Convention is examined, along with broccoli- and tomato-related lawsuits.
