In the Penal Code adopted by Law no. 286/2009, misappropriation is incriminated as a service offense, and not against patrimony, such as in the Criminal Code of 1969. However, the new regulation presents some peculiarities the active subjects of crime, aggravated variant content and special limits of punishment provided for each normative version.
