The article under consideration covers some conceptual issues in definition of the process of amending the Constitution of Ukraine. The author substantiates the inconsistency of this definition, its inconsistency, which has a negative impact on legislative regulation and practice of the constitutional process in Ukraine. The emphasis is made on inconsistency of legal positions of the Constitutional Court of Ukraine in the issues related to constitutional process. The fallacy of understanding the subject of the constitutional process is proved in the article. The author criticized the removal of the people as a subject of constitutional process from execution of the constituent power. The need for fundamental changes in the concept of the constitutional process, its democratization, simplification and rationalization is argued in the article. [ABSTRACT FROM AUTHOR] |
