The article discusses the restructuring of the trademark dilution by blurring in the Trademark Dilution Revision Act of 2006 (TDRA). Topics discussed include the origin of modern-day application of the TDRA and its blurring factors, the application of the factors in several key cases to ascertain if they are effective in achieving the purpose of policing trademark dilution by blurring, and the changes made by the U.S. Congress to anti-dilution law through the TDRA. |
