Abstrakt: |
The article examines the relevant provisions of the Leahy-Smith America Invents Act (AIA) and explores the ways by which the Act would put emerging companies at a disadvantage. It relates the impact of the decision of the U.S. to change from a first-to-invent to a first-inventor-to-file system. The ways by which third parties can challenge the issuance and validity of patents under the AIA are outlined. |
