The article focuses on vapor intrusion regulation and its potential for litigation. It highlights guidance for assessment of the vapor intrusion pathway and examines the potential for government enforcement actions and suits involving vapor intrusion. It states that the U.S. Environmental Protection Agency (EPA) has explained vapor intrusion as the migration of subsurface chemicals into overlying structures. It discusses the impact of heating, ventilation, and cooling systems (HVAC) on volatilized chemical concentrations. It mentions about draft guidance issued by the EPA for evaluating the vapor intrusion including the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Resource Conservation and Recovery Act (RCRA). |
