The article discusses the principle of subrogation of Medicare payments from its beneficiaries. It highlights the process of recovering Medicare payments and its impact on the litigation of tortious injuries. It presents the U.S. Supreme Court case Ark. Dep't of Health & Human Servs. v. Ahlborn which was regarding the ability of a state agency to claim a personal injury settlement as compensation for Medicaid benefits provided for treatment of the injuries. |
