The article features the fourth in a series of papers summarizing Montreal Convention 1999 (MC99) judicial decisions covering the period 2010-2012. In Australia, the New South Wales Court of Appeal held that the two-year limitation period of Article 29 of the 1929 Warsaw Convetion does not apply to bar a claim for indemnity for workers' compensation payments. In France, deep vein thrombosis does not consist of a accident within the meaning of Article 17 of the Warsaw Convention. |
