Compensable Regulations for Open Space: A Means of Controlling Urban Growth.

Abstrakt: The authors present a novel technique for controlling the location and timing of urban development through the preservation of temporary and permanent open space. They maintain that existing techniques are largely unsatisfactory for this purpose: zoning and related controls, because they involve no compensation; the acquisition of development rights, because it freezes planning decisions and inflates costs. Under the authors' proposal, controls on development are imposed by regulations similar to zoning but with a governmental guarantee that the owner will receive, when he sells his property in the open market, a price equal to the value of his property just before the controls were imposed.
