Abstrakt: |
The article discusses the conflicts between U.S. and Latin American courts over tort litigation, including enforcement of foreign judgments. An overview of the conflict is provided including the causes of conflict resulting from U.S.-created chaos over jurisdiction and choice of law. The choice of whether to litigate tort claims or enforce foreign judgments in U.S. courts is discussed in relation to the trend among U.S. courts for liberalize enforcement and its impact on foreign relations. |
