Abstrakt: The article offers the author's insights on gang expert testimony and how reliance on testimonial hearsay violates the Crawford principal. He notes that the Supreme Court change the criteria for admissibility to an absolute exclusion of testimonial hearsay from unavailable declarants absent a prior right of cross-examination in Crawford. Moreover, he offers a method in reconciling Washington Rule of Evidence 703 (ER 703) with the Crawford requirements.
