Abstrakt: The article focuses on issues related to bankruptcy and arbitration in the context of the International Chamber of Commerce (ICC). It examines why insolvency laws interfere with arbitral proceedings, noting that insolvency and arbitration laws have different objectives. It discusses jurisdictional issues that arise for arbitrators when a party to ongoing arbitral proceedings files for bankruptcy after the commencement of arbitration but before an award is rendered. ICC cases are discussed.
