| Abstrakt: | The article discusses the way in which tortfeasors with reduced mental capacity are handled under the common law of negligence in Australia. It is stated that adequate explanation for this discrepancy is not provided by academic analyses and courts' reasons. Several proposals for resolving this dissonance are also provided in the article. |
