Abstrakt:	Th earticle discusses the study which outlines the excited utterance exception to the hearsay rule. It elaborates the admissibility of hearsay evidence in prosecutions for domestic or family violence wherein the abused party does not cooperate. It examines the court ruling that allows the victim's statements made at the time of the incident. However, the authors reveal that the courts have remained divided on the issue of admissibility of excited utterances to police or medical personnel when victims refuse to participate in the prosecution of the perpetrators.
