Abstrakt:	The article focuses on the disagreements about the arbitrability of particular claims which can negatively affect the efficiency of arbitration. This article reviews who is empowered to determine the validity and enforceability of arbitration provisions as various courts in the U.S. have taken different approaches. This issue has received significant scrutiny in state and federal courts, with varying results. It also cites several cases and the decisions taken by judicial agencies.
