Abstrakt: The article reports on guidance provided by the Federal Deposit Insurance Corporation (FDIC) to the American Securitization Forum (ASF) regarding Title II of the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 in the U.S. Also known as Orderly Liquidation Authority (OLA), Title II prohibits future taxpayer bailouts of finance companies considered too big to fail under the Bankruptcy Code. The guidance stated that the repudiation authority of the FDIC has long existed with respect to banks under the Federal Deposit Insurance Act.
