| Abstrakt: |
The article examines the original meaning of the Cruel and Unusual Punishment Clause in the U.S. Constitution. It suggests that the Supreme Court could have reached the similar result it did in the case Graham v. Florida had it relied on the original meaning of the Cruel and Unusual Punishments Clause. According to the author, the court decision would have been more plausible and the Court's jurisprudence would have been more sustainable if the original meaning of such clause is considered. |
